Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TalkDoc mobile application (the "App") operated by OurThinkTank ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age to use TalkDoc. By using the App, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Account Registration

Some features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account.

3. Use of the App

TalkDoc provides tools for creating structured documents from voice recordings. You may use the App for lawful purposes consistent with these Terms. You agree not to use the App to violate any applicable laws or regulations, infringe on the rights of others, distribute harmful or malicious content, attempt to gain unauthorized access to our systems or other users' accounts, or reverse engineer, decompile, or otherwise attempt to extract the source code of the App.

4. Your Content

You retain ownership of all content you create using TalkDoc, including voice recordings and generated documents ("Your Content"). By using the App, you grant us a limited, non-exclusive license to process Your Content solely for the purpose of providing the App's functionality to you. We do not claim ownership of Your Content and will not use it for any purpose other than delivering the service.

5. Subscriptions and Payments

TalkDoc offers a free tier with limited document creation and a paid subscription ("Pro") that provides unlimited access. Subscriptions are managed through your device's app store (Apple App Store or Google Play). Billing, renewal, and cancellation are governed by the policies of the applicable app store. You can manage your subscription through your device's account settings.

6. AI-Generated Content

TalkDoc uses artificial intelligence to parse voice transcripts and generate structured documents. AI-generated content is provided "as-is" and may contain errors or inaccuracies. You are responsible for reviewing all generated documents before use or distribution. We do not guarantee the accuracy, completeness, or fitness for any particular purpose of AI-generated content.

7. Intellectual Property

The App, including its design, features, code, and branding, is owned by OurThinkTank and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without prior written consent.

8. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, OurThinkTank shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of or related to your use of the App. Our total liability for any claim arising under these Terms shall not exceed the amount you have paid us in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless OurThinkTank and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the App or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Texas.

13. Changes to These Terms

We may revise these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App and updating the "Effective Date" above. Your continued use of the App after any changes constitutes acceptance of the revised Terms.
